Deckla

Terms of Use

The agreement, in plain words.

This is the licence agreement for Deckla, between you and DevScape. Apple requires parts of it and we have kept the rest as short as it can honestly be. Installing or using Deckla means you accept it.

Effective 30 September 2026 · Applies to Deckla for iPhone and iPad

1

Who this agreement is with

Deckla is published by DevScape.io LLC ("we", "us", "our"), of 5511 Parkcrest Drive, Suite 103, Austin, TX 78731, United States. This agreement is between you and us alone.

Apple is not a party to it. Apple Inc. and its subsidiaries are not responsible for Deckla or its contents, and have no obligation to furnish any maintenance or support for it. Section 11 sets out the rest of what Apple requires us to say, including the one right Apple does have under this agreement.

2

Your licence

We grant you a personal, non-transferable, non-exclusive licence to use Deckla on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's App Store Terms of Service. You may not distribute the app over a network where it could be used by several devices at once.

Deckla Pro is sold as a single non-consumable purchase and is not Family Shareable. It unlocks on the Apple Account that bought it, across that account's devices.

You agree not to:

  • Copy, sell, rent, sublicense or redistribute the app.
  • Reverse-engineer, decompile or disassemble it, except to the extent that law expressly permits despite this restriction.
  • Remove or obscure any copyright or other proprietary notice.
  • Work around the parts that Deckla Pro unlocks, or interfere with how purchases are verified.
  • Use the app to break the law, or in a way that damages, disables or overburdens anyone else's systems — Apple's iCloud included.

Everything not expressly granted here is reserved. The licence is a licence, not a sale of the software itself.

3

Who may use it

You must be at least 13, or older if that is the age in your country at which you can agree to terms like these on your own. If you are under the age of majority where you live, a parent or guardian must read and accept this agreement with you.

You also confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties. This confirmation is one Apple requires of every app.

4

Deckla Pro, and the free trial

What it is

A one-time purchase, not a subscription. Nothing renews, nothing recurs, and there is nothing to cancel. It unlocks undo, hints, the sharp opponent and your full statistics history. Both card decks are free.

The trial

Deckla gives you undo and hints free for seven days from first launch. The sharp opponent and the full statistics history are not part of the trial; they come with the purchase. When the trial ends, the app keeps working — the games and your saves all continue — and undo and hints become locked until you buy, after a few free uses of each. No card is required to try it, because there is nothing to charge.

Price

The price shown in the App Store at the moment of purchase is the price, in your local currency and inclusive of tax where Apple collects it. Prices may differ between territories and may change for future buyers; a change never affects a purchase already made.

Restoring it

Reinstalling, or signing in on another of your devices, restores the unlock with Restore purchases. Because the entitlement lives in your Apple Account rather than with us, we cannot restore it for you and never need to be asked.

We may add, change or retire features over time — including which ones sit behind Pro. We will not take away a feature you have already paid for.

5

Refunds

Apple is the seller of Deckla and of Deckla Pro, and all purchases are governed by Apple's Media Services Terms and Conditions. Refunds are requested from Apple, not from us, at reportaproblem.apple.com. We have no ability to issue, refuse or expedite one.

If you are a consumer in the UK or the EEA, your statutory rights — including the right to a remedy for digital content that is faulty or not as described — are unaffected by anything in this agreement, and are exercised against Apple as the seller. Nothing here limits rights that cannot lawfully be limited.

6

Playing with other people

This version of Deckla is played against the app only.

There is no multiplayer, no chat and no public profile, so nothing you do in Deckla is shown to another person. If playing other people is added, this section will say what applies to it before that version is released.

7

iCloud, your saves, and backups

Deckla syncs through your own iCloud account using Apple's CloudKit. That part of the service is Apple's, subject to Apple's terms and to your iCloud storage and availability. If iCloud is unavailable, or you are signed out, the app plays on the one device.

Keep your own backups. We hold no copy of your saves, statistics or matches and therefore cannot recover them — not after a deleted app, a lost device, an iCloud problem or a mistake. A device backup is the only thing that can.

What Deckla stores and where it goes is set out in full in the Privacy Policy, which forms part of this agreement.

8

Who owns what

Deckla — its code, artwork, card designs, text and the name and logo — belongs to us or our licensors and is protected by copyright and other laws. The Sora typeface is used under the SIL Open Font Licence.

The card games themselves are not ours and are not claimed: Gin Rummy, 500 Rummy, Sequence, Spite and Malice, War and Go Fish are traditional or third-party games, and their rules are facts rather than property. Deckla is an independent implementation and is not affiliated with, endorsed by or sponsored by any publisher of a physical card game of a similar name. Any such trade marks belong to their owners and are used only to say which game is which.

9

Warranty

To the fullest extent the law allows, Deckla is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that it will be uninterrupted or error-free, or that every deal, score and rule reading will suit every table.

If the app fails to conform to any warranty that does apply, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Deckla. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility alone.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. If you are a consumer, your statutory rights are unaffected.

10

Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost data, lost saves or lost matches, arising out of your use of Deckla. Our total liability to you for any claim relating to the app is limited to the amount you actually paid for it.

Nothing in this agreement excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, this section does not affect your statutory rights, and some jurisdictions do not allow these limits at all.

11

The clauses Apple requires

Apple asks every developer to make these points explicitly. They are collected here rather than scattered, so you can read them in one go.

  1. This agreement is between you and us, not Apple. We, not Apple, are solely responsible for Deckla and its content.
  2. Scope of licence. Your licence is the one in §2, and it is limited by the Usage Rules in Apple's App Store Terms of Service.
  3. Maintenance and support. We are solely responsible for it. Apple has no obligation whatsoever to furnish any maintenance or support services for Deckla.
  4. Warranty. As in §9: on a failure to conform, Apple will refund the purchase price, and beyond that Apple has no warranty obligation. Everything else is ours.
  5. Product claims. We, not Apple, are responsible for addressing any claim by you or a third party relating to Deckla or your use of it — including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  6. Intellectual property claims. If a third party claims that Deckla infringes their intellectual property, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You confirm the embargo and prohibited-party points in §3.
  8. Developer name and contact. Questions, complaints and claims about Deckla go to the address in §14.
  9. Third-party terms. You must comply with any applicable third-party terms when using Deckla — Apple's iCloud and App Store terms in particular.
  10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of it Apple has the right — and is deemed to have accepted the right — to enforce it against you as a third-party beneficiary.

12

Governing law

This agreement is governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules, and the state and federal courts of Texas have exclusive jurisdiction over any dispute arising out of it.

If you are a consumer resident in the UK or the EEA, this choice does not deprive you of the protection of the mandatory consumer law of the country you live in, and you may bring proceedings there.

13

Ending this, and changing it

Ending it

The licence ends when you delete Deckla, or if you materially breach these terms. Sections 8 to 12 survive. Ending the licence does not entitle you to a refund; refunds are Apple's, under §5.

Changing it

We may update these terms — for a new feature, or a change in the law. The effective date at the top changes with them, and a material change will be surfaced in the app before it takes effect. Continuing to use Deckla after that is acceptance.

Severability and waiver. If any part of this agreement is held unenforceable, the rest stands and the unenforceable part is narrowed to the least extent necessary. Our not enforcing something is not a waiver of it. This agreement and the Privacy Policy are the whole agreement between us about Deckla.
